Edward Zohn represented defendant Thomas Cassidy, who appealed the failure to suppress evidence seized from his home pursuant to a defective domestic violence temporary restraining order (TRO). The State conceded the invalidity of the TRO. The question was whether weapons seized as a result of the search may be used in defendant’s subsequent criminal prosecution for possession of illegal firearms. The New Jersey Supreme Court reversed the judgment of the Appellate Division, and Mr. Cassidy’s convicions for illegal possession of firearms were overturned.
